GENERAL TERMS AND CONDITIONS - SUMMER 2023
1. The Company, owner of the concession, during the summer season makes an integrated system of lifts as detailed on the website www.ski.it
2. These general conditions regulate the conditions of contract for the purchase and use of all tickets or travel passes and pre-paid badges issued by the company. Sections III and IV regulate the terms and conditions for the use of tickets or travel passes and pre-paid badges sold through certified portals Telepass and Mypass.
3. The purchase and possession of a ticket or travel pass implies awareness and full acceptance of these terms and conditions.
Section I - Tickets and Travel Passes
4. Users are obliged to purchase a ticket according to their programme of use. The company sells tickets or travel passes from its own ticket office in Pinzolo as well as online, from the website www.ski.it. Tickets can also be purchased from the certified portals Telepass and Mypass according to the relevant conditions of sale.
5. Tickets prices are provided in the lists on display at the aforementioned ticket office or published online at the website www.ski.it and include VAT. Prices for tickets sold on the website www.ski.it are subject to variation.
6. The ticket office accepts payment in cash (compliant with the current laws) as well as major debit and credit cards. The Management also accepts payment via bank transfer, which must be sent to and result as paid at the Administration Office before any tickets or travel passes can be issued. Any requests for invoices for badges must be made before said badges are issued.
7. When collecting their ticket or travel pass, the customer must ensure that the pass complies with their request; no ticket or travel pass can be exchanged once the customer has used it to register their first access to the lifts.
8. Tickets or travel passes (excluding single rides) are sold on Key-Cards; each one requires payment of a deposit of 5.00 euros, which will be returned if the card is returned intact and in good condition.
9. Tickets or travel passes are transport documents that also serve as a receipt (D.M. 30.06.1992 and subsequent amendments) and must be kept for the duration of transport.
10. The ticket or travel pass must be presented to lift staff every time they request them. Staff need to check validity and ensure the correct identity of the ticket or ticket holder.
11. The ticket or travel pass is a personal document and cannot be transferred, even free of charge. Any improper use of the ticket or travel pass and specifically, transfer of same, even if as a simple and/or momentary exchange, will lead to its the immediate withdrawal and cancellation, with the possibility that legal action (civil or criminal) will be taken against the offender. Control systems are active for all types of tickets or travel passes, including systems using photo compare technology (installed on lift access turnstiles) that are able to detect the user’s image (see privacy policy displayed at all ticket offices and published at www.ski.it).
12. Replacement hourly tickets and single rides cannot be issued in case of loss. In case of loss of daily, multiple-day or seasonal passes, to obtain a replacement it is necessary to report the loss to the company, which will deactivate and block the lost pass. In any case, all replacement tickets are issued directly from the ticket office, exclusively upon presentation, by the customer, of a photograph of said card, which must show the ID code of the card or the booking code in case of online purchase. The charge for deactivating and blocking a lost ticket and issuing a new card is € 10.00 (non-refundable if the original pass is found).
13. Tickets or travel passes that are issued upon presentation of vouchers will only be provided in the same format stated on the voucher and cannot be changed in any way, even prior to issue.
14. All tickets, single rides included, will expire at the end of the relevant summer season.
15. The tickets or travel passes are non-refundable in case of illness, accident or for personal reasons of the holder.
16. In case of accidents with injury occurring on marked routes or tracks during summer amateur sport activities which have been duly documented by First Aid medical documentation, the insurance policy “ItasActive” (available for purchase together with the tickets or travel passes, and under the terms and conditions of the policy, which are available in summary form at all company ticket offices and on the website www.ski.it) includes a partial refund of the insured multi-day pass valid for a minimum of three days; it remains understood that anyone accompanying the injured party, even if insured, will not be entitled to a refund on their ticket or travel pass.
Section II - Types of Company Tickets or Travel Passes
17. The types of tickets (single ride, hourly, daily, multi-day - up to 6 days or seasonal) are stated on the price lists displayed at the ticket offices and published on the website www.ski.it. “Pay per use” passes are also available, according to the relevant conditions of sale from the certified portals Mypass and Telepass.
18. Differently able people who, at the time of purchase, provide documentary proof of disability, issued by the competent authorities and certifying disability of 50% or more, or between 20% and 49% will be entitled to a discount on list prices of 50% and 25% respectively on hourly PM tickets, on PM tickets valid from 1 to 6 consecutive days as well as on single journeys on PI gondola and chairlift.
19. Superskirama season passes –-according to the interchange agreements in being between the cable lift companies, as well as the lift operating programmes decided by the Management of each of the aforementioned companies – and the Company’s season passes provide access to the lifts in operation in the area of reference throughout the 2023 summer season. The 2023 summer season - without prejudice to the undisputable right of the management of each lift company to set the start and end dates for same on the relevant lifts - is 30 days, even for non-consecutive days, in the period included between June and September 2023. It is understood that:
a) the operation of all lifts in the area of reference cannot be guaranteed;
b) in case of single lifts or groups of lifts being in operation for a period exceeding 30 days the season pass will remain valid for said further period;
c) in the event that lifts are closed for safety reasons linked to the SARS-CoV-2 virus and the 30-days of validity cannot be used, the customer will be refunded an amount according to the price of the seasonal pass and the number of days not used compared to those guaranteed.
Section III - Lift Operation Schedule
20. The lift operation of the company and that of the lift operators in the area covered by the ticket or travel pass is decided by the company management and the management of each of the lift companies. The cost of the ticket or travel pass is not linked to the number of lifts open to the public. The object of the contract is the transport from the valley station to the summit station of the single lift or vice versa. Any activity following the use of the lift facilities (trekking, mountain biking, etc.) is not the object of the contract and is carried out exclusively at one’s own risk.
21. The company is not in any case liable, and therefore, no refund (total or partial) or replacement of the ticket or travel pass is owed if, due to unforeseen events which in no way depend on the company’s wishes (for example, but in no way limited to, storms, excessive wind or the occurrence of an unforeseeable technical problem, the repeated and unannounced suspension of electricity) the lifts should be closed fully or in part.
The company can also not be held liable and therefore, no refund and/or compensation is owed in the event that, due to the closure of lifts on account of force majeure, the user should incur costs to return to his/her residence or departure point.
Section IV - Rules for Lifts Use
22. Lift users are obliged to comply with the transport rules and guidelines, as displayed at all lift departure stations; lift users are also obliged to follow the regulations of the competent authorities in the interests of safety and smooth transport, and all other instructions that may be given by lift employees in order to prevent accidents.
23. The company declines all responsibility for damages arising from the improper use of the lift facilities, including the consequences of illicit behaviour posed by the lift facility users during their presence on the lift facilities. With the purchase of a child's ticket or acceptance of a free ticket, the purchaser and/or person accepting the ticket will accept all liability regarding the use of lifts by the minor, who will use said ticket under the direct supervision of the purchaser and/or person accepting the ticket.
24. Children under the age of eight years may only use the lift if accompanied by an adult; no proof of age is required for children more than 1.25 metres in height (Min. Decree 8 March 1999 and subsequent amendments).
25. Dogs must be muzzled and kept on a leash at all times. Dogs are only permitted to use gondola lifts.
26. Customers undertake to comply with all of the regulations in place to manage the COVID-19 pandemic and specifically, at the time of purchasing ticket or collecting any badges for lift use, they must be liable for and informed of their health condition and that of their family unit (understood as people with whom they share confined spaces, such as means of transport, hotel rooms, living units, etc.), undertaking, if this is not the case, not to use lifts and to report any symptoms, as necessary.
Concluding from this, by accessing lifts:
i. Customers state that they have none of the symptoms known to be traceable to the COVID-19 pandemic, and nor does any member of their family unit (understood as people with whom they share confined spaces, such as means of transport, hotel rooms, living units, etc.);
ii. and they undertake to comply with the regulations put in place to deal with the epidemiological emergency of COVID-19 as they come into force.
Section V - Bike
27. For the 2023 summer season, the Brenta Bike Park will be closed.
28. Transport of a mountain bike on the lift facilities is permitted at no additional cost to all holders of one-way or round-trip tickets, single-day, multiple-day and seasonal passes.
29. The company does not manage the various bike tracks/routes present on the territory which result external to the Brenta Bike Park.
Section VI - Final Provisions
32. In case of discrepancies between the languages of these general conditions of sale, the Italian version shall prevail.
33. The company has put in place the measures required by the new General Data Protection Regulation (GDPR 679/2016), as per the policy statement displayed at ticket offices or on the company website www.ski.it.
